NextPing is a messaging platform operated by Nexoria Enterprise, a US-based company ("we," "us," or "NextPing"). NextPing provides the tools to send SMS and MMS messages. You — the sender — are solely responsible for the content of your messages, the recipients you message, and your compliance with all applicable laws and carrier requirements. NextPing does not guarantee message delivery, which depends on mobile carriers and factors outside our control.

All messaging through NextPing must comply with the Federal Communications Commission (FCC) rules, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA messaging guidelines. By using the platform you agree to the following:

• Prior express consent. You may only message individuals who have given you prior express written consent to receive text messages. You must retain proof of consent.
• Opt-out / STOP. Every recipient must be able to opt out at any time. Replies of STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT are honored automatically and immediately, and those numbers are permanently suppressed.
• Opt-in HELP. Recipients can reply HELP for assistance and your business identification.
• Sender identification. Messages must clearly identify your business.
• No prohibited content. No SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) except where lawfully permitted and age-gated, and no illegal, deceptive, or fraudulent content.
• 10DLC / A2P registration. Application-to-person messaging requires brand and campaign registration with the carriers. You must provide accurate business information for verification.
• Quiet hours. Respect quiet hours and applicable federal, state, and local time-of-day restrictions.

We may suspend or terminate any account that violates these requirements or that generates excessive carrier violations or spam complaints.

You agree not to use NextPing to send unsolicited, unlawful, harassing, defamatory, or misleading messages, or to violate any third party's rights. You are responsible for maintaining the accuracy of your contact lists and for removing recipients who have opted out.

No refunds. All payments, plan fees, wallet top-ups, and usage charges are non-refundable. Amounts paid for messages and phone numbers are final once the service is rendered or provisioned.

Cancellation. You may cancel at any time to stop future subscription charges. Cancellation takes effect at the end of your current billing term — your plan remains active until the end of the period you've already paid for, and you will not be billed again afterward. No partial or prorated refunds are issued for the remainder of a term.

Phone number fees are billed monthly in advance and are likewise non-refundable. Releasing a number stops future charges at the end of the current term.

To the maximum extent permitted by law, NextPing and Nexoria Enterpriseare not liable for any indirect, incidental, or consequential damages, or for undelivered or delayed messages. Our total liability for any claim is limited to the amount you paid to us in the preceding 30 days.

We collect the information you provide (account, business, and compliance details) and the contact data you upload, solely to operate the service. We do not sell your data. You are the controller of the contact data you import and are responsible for having a lawful basis to process it.
