Terms & Conditions

NextPing is a messaging platform operated by Nexoria Enterprise, a US-based company ("we," "us," or "NextPing"). NextPing provides the tools to send SMS and MMS messages. You — the sender — are solely responsible for the content of your messages, the recipients you message, and your compliance with all applicable laws and carrier requirements. NextPing does not guarantee message delivery, which depends on mobile carriers and factors outside our control.

All messaging through NextPing must comply with the Federal Communications Commission (FCC) rules, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA messaging guidelines. By using the platform you agree to the following:

• Prior express consent. You may only message individuals who have given you prior express written consent to receive text messages. You must retain proof of consent.
• Opt-out / STOP. Every recipient must be able to opt out at any time. Replies of STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT are honored automatically and immediately, and those numbers are permanently suppressed.
• Opt-in HELP. Recipients can reply HELP for assistance and your business identification.
• Sender identification. Messages must clearly identify your business.
• No prohibited content. No SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) except where lawfully permitted and age-gated, and no illegal, deceptive, or fraudulent content.
• 10DLC / A2P registration. Application-to-person messaging requires brand and campaign registration with the carriers. You must provide accurate business information for verification.
• Quiet hours. Respect quiet hours and applicable federal, state, and local time-of-day restrictions.

We may suspend or terminate any account that violates these requirements or that generates excessive carrier violations or spam complaints.

Program name: NextPing. Consent for marketing messages is collected separately from consent for transactional and account messages. By checking the marketing consent box, you agree to receive recurring automated marketing and promotional SMS/MMS messages from NextPing at the mobile number you provide. A separate, optional box covers transactional and account-related messages. Consent is not a condition of purchase. Msg & data rates may apply. Msg frequency varies based on your activity and the campaigns you subscribe to.

End users opt in through separate, unchecked consent boxes on our SMS opt-in form. The marketing consent disclosure states: “I agree to receive recurring automated marketing and promotional text messages from NextPing at the mobile number provided. Consent is not a condition of any purchase. Msg & data rates may apply. Msg frequency varies. Reply STOP to opt out, HELP for help.”

By replying START, subscribing through our opt-in form, or otherwise giving written/verbal consent, you confirm that you are the account holder or customary user of the mobile number provided and that you authorize NextPing to send text messages to that number.

• Opt out: Reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to cancel at any time. After opting out, you will receive one final confirmation message and no further messages unless you opt in again.
• Help: Reply HELP for help or contact us at support@nextpingtxt.com.
• Privacy: We handle your information according to our Privacy Policy. Mobile opt-in data and consent are not shared with third parties or affiliates for marketing or promotional purposes.
• Message content: Messages may include account alerts, appointment confirmations, customer-care updates, and promotional or marketing offers. Messages may contain links to https://www.nextpingtxt.com.
• Carrier notice: Wireless carriers are not liable for delayed or undelivered messages.

You agree not to use NextPing to send unsolicited, unlawful, harassing, defamatory, or misleading messages, or to violate any third party's rights. You are responsible for maintaining the accuracy of your contact lists and for removing recipients who have opted out.

No refunds. All payments, plan fees, wallet top-ups, and usage charges are non-refundable. Amounts paid for messages and phone numbers are final once the service is rendered or provisioned.

Cancellation. You may cancel at any time to stop future subscription charges. Cancellation takes effect at the end of your current billing term — your plan remains active until the end of the period you've already paid for, and you will not be billed again afterward. No partial or prorated refunds are issued for the remainder of a term.

Phone number fees are billed monthly in advance and are likewise non-refundable. Releasing a number stops future charges at the end of the current term.

To the maximum extent permitted by law, NextPing and Nexoria Enterpriseare not liable for any indirect, incidental, or consequential damages, or for undelivered or delayed messages. Our total liability for any claim is limited to the amount you paid to us in the preceding 30 days.

We collect the information you provide (account, business, and compliance details) and the contact data you upload, solely to operate the service. We do not sell your data. You are the controller of the contact data you import and are responsible for having a lawful basis to process it.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all information sharing and will not be shared with any third parties. See our full Privacy Policy and our SMS opt-in form.
